Purpose of This Agreement

Welcome to Launch You! We're excited to help you build and launch your online business through our comprehensive training programs and tools. This Agreement sets forth your rights and obligations as a user of our Services. By using our Services, creating an account, or making a purchase, you agree to be bound by these Terms.

Binding Agreement

These Terms of Service, together with our Privacy Statement, form a legally binding agreement between you and Launch You, LLC. This Agreement governs your access to and use of all our Services, including but not limited to:

• LaunchPad Program
• Funnel Launch platform
• Mentors.com training hub
• Fourtopia app
• Ultimate Life Blueprint
• All AI-powered tools and features

Section 1 - Eligibility and Account Creation

Age Requirement: You must be at least 18 years old to use our Services.

Business Representation: You represent that you operate or intend to operate a legitimate business and will use our Services for lawful business purposes only.

Account Security: You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Immediately notifying us of unauthorized access

Prohibited Agency Accounts: You may not create accounts to provide services to third parties or operate as an agency without our express written permission.

Section 2 - Subscription Services and Pricing

LaunchPad Program:

• Option 1: $497 upfront + $147/month
• Option 2: $1,297 annual payment

Funnel Launch:

• $129/month subscription

Payment Terms:

• All fees are non-refundable except as specifically stated in our refund policy
• Automatic billing occurs monthly or annually based on your selected plan
• You authorize us to charge your payment method for recurring fees
• Prices may change with 30 days' notice

Free Trials: Some services may offer free trials. You must cancel before the trial ends to avoid charges.

Section 3 - Automatic Renewal and Cancellation

Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before renewal.

Cancellation Process:

• Cancel through your account dashboard or email [email protected]
• Cancellation takes effect at the end of your current billing period
• No partial refunds for unused time
• Access continues until the end of your billing period

Section 4 - Refund Policy

Digital Products: 30-day money-back guarantee for most digital products, provided you:

• Request refund within 30 days of purchase
• Have not completed more than 50% of the course content
• Submit refund request to [email protected]

Subscription Services: First month refundable within 30 days; subsequent months non-refundable

Exclusions: Refunds may be denied for:

• Violation of these Terms
• Abuse of our refund policy
• Completion of significant portions of content

Section 5 - User Conduct and Restrictions

Permitted Use: You may use our Services for legitimate business education and development purposes.

Prohibited Activities:

• Sharing login credentials with others
• Downloading or distributing our content without permission
• Using our Services for illegal activities
• Harassing other users or staff
• Attempting to hack or disrupt our Services
• Using automated tools to access our content
• Creating multiple accounts to circumvent limitations

Content Guidelines:

• No hate speech, harassment, or discriminatory content
• No spam or unsolicited promotional content
• No false or misleading information
• Respect intellectual property rights

Section 6 - Intellectual Property

Our Content: All course materials, software, AI tools, and other content are protected by copyright and remain our exclusive property.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use our content solely for your personal business development.

User Content: You retain ownership of content you create, but grant us a license to use it for service delivery and improvement.

AI-Generated Content: Content generated by our AI tools is owned by Launch You, LLC, though you may use it for your business purposes.

Section 7 - AI-Powered Features

Odyssey AI and Other Tools: Our AI features are provided "as is" and:

• Generate suggestions based on your inputs
• May not always be accurate or suitable for your specific situation
• Should not be considered professional advice
• Require your own judgment and expertise to implement

Data Usage: We may use your interactions with AI tools to improve functionality, but will protect your personal information according to our Privacy Statement.

Section 8 - Affiliate Program

Participation: Approved affiliates may promote our products for commission.

Requirements:

• Comply with all applicable laws and regulations
• Use only approved marketing materials
• Maintain professional standards
• Follow our affiliate agreement terms

Termination: We may terminate affiliate relationships at any time for any reason.

Section 9 - Disclaimers

Disclaimer: We provide our services "as is" without warranties of any kind. We disclaim any implied warranties including merchantability, fitness for particular purpose, and non-infringement.

Section 10 - Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content you submit or create using our Services

Section 11 - Limitation of Liability

Maximum Liability: Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

Excluded Damages: We are not liable for indirect, special, incidental, or consequential damages, including lost profits or business interruption.

Business Risk: You acknowledge that starting and running a business involves inherent risks, and we are not responsible for your business success or failure.

Section 12 - Dispute Resolution and Arbitration

Mandatory Arbitration: Any disputes will be resolved through binding arbitration rather than court proceedings, except for:

• Small claims court matters
• Intellectual property disputes
• Requests for injunctive relief

Arbitration Process:

• Conducted by the American Arbitration Association
• Individual arbitration only (no class actions)
• Location: Delaware or your state of residence
• Delaware law applies

Class Action Waiver: You waive your right to participate in class action lawsuits.

Section 13 - Compliance with Laws

You agree to comply with all applicable laws, including:

• Anti-spam regulations (CAN-SPAM Act, GDPR)
• Consumer protection laws
• Tax obligations
• Advertising and marketing regulations
• Data protection laws

Section 14 - Termination

By You: Cancel your account at any time through your dashboard or by contacting support.

By Us: We may terminate or suspend your account for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent activity
• Any reason with 30 days' notice

Effect of Termination: Upon termination, your access ends immediately, but certain provisions survive (payment obligations, intellectual property, dispute resolution).

Section 15 - General Provisions

• Entire Agreement: These Terms and our Privacy Statement constitute the entire agreement between us.
• Severability: If any provision is found unenforceable, the remainder remains in effect.
• No Waiver: Our failure to enforce any provision doesn't constitute a waiver.
• Assignment: We may assign our rights and obligations; you may not without our consent.
• Force Majeure: We're not liable for delays due to circumstances beyond our control.
• Governing Law: Delaware law governs this Agreement.

Section 16 - Code of Ethics

All users of Launch You's platforms are expected to adhere to our Code of Ethics, which includes:

• Honest Marketing: Present your products and services honestly. Do not make false or misleading claims about results customers can expect.
• Earnings Claims: Do not promise specific income amounts unless you have documented proof. Avoid phrases like "guaranteed income" or "easy money."
• Testimonials: Only use genuine testimonials with appropriate disclaimers ("Results shown are not typical and may vary").
• Legal Compliance: Follow all applicable laws including anti-spam regulations (CAN-SPAM, GDPR) and consumer protection laws.
• Respect IP: Do not copy or redistribute Launch You's copyrighted materials or share login credentials.
• Professional Conduct: Treat all community members with respect. No harassment, discrimination, or offensive behavior.

Violation of our Code of Ethics may result in warning, suspension, or termination of your account.

Section 17 - DMCA Policy

Launch You respects intellectual property rights. In accordance with the Digital Millennium Copyright Act (DMCA):

• We will respond promptly to valid notices of alleged copyright infringement
• We will remove or disable access to allegedly infringing content
• We maintain a policy of terminating repeat infringers' accounts

To report copyright infringement, email [email protected] with subject line "DMCA Takedown Notice" and include: identification of the copyrighted work, location of the infringing material, your contact information, and a statement of good faith belief.

Section 18 - SMS/Text Messaging Terms

If you opt into our SMS/text messaging program:

• Message Types: You may receive course updates, live training reminders, account notifications, and promotional offers
• Frequency: Message frequency varies; marketing messages limited to 4 per month maximum
• Costs: Standard message and data rates apply per your cellular plan. Launch You does not charge additional fees.
• Opt-Out: Text "STOP" to unsubscribe at any time. You will receive a confirmation message.
• Help: Text "HELP" for assistance or email [email protected]
• Privacy: We do not sell or share your mobile number with third parties for their marketing purposes

Carriers are not liable for delayed or undelivered messages.

The following policies are incorporated by reference and form part of this Agreement:

• Refund Policy - Our refund terms and procedures

By using our Services, you agree to all of these policies.
